Her Story

At the age of 42, our client came to Australia on a Student Guardian Visa (Subclass 590) to accompany her son while he undertook his studies in Australia.

Having primarily focused on home duties for approximately 10 years, she wanted to explore whether there was a realistic pathway for her to remain in Australia and build a future for her family.

She approached our team to understand her migration options.

After carefully reviewing her personal circumstances, background, age, family situation and long-term objectives, we developed a tailored pathway designed around her individual circumstances.

We recommended that she undertake an Aged Care course to develop relevant skills and qualifications and then pursue an employer-sponsored pathway through the Aged Care Industry Labour Agreement, subject to meeting the applicable requirements.

Her journey demonstrates that a client’s starting point does not necessarily define their future options. With the right assessment and carefully planned pathway, she was able to transition from a Student Guardian Visa to a potential skilled employment and employer-sponsored pathway.

From No Clear Migration Pathway to an Employer-Sponsored Career in Australia

His Story

At the age of 48, our client from China approached us to explore his options for migrating to Australia.

He had no formal qualifications and no business background, English is very limited.

After reviewing his background, we initially found that there was no obvious skilled or business migration pathway that suited his circumstances.

Rather than simply telling him that migration was not possible, we looked at his practical skills, physical fitness, employment potential and long-term migration objectives.

Finding an Alternative Pathway

After assessing his circumstances, we identified the Australian meat processing industry as a potential pathway that could suit his profile.

We recommended that he return to China and enter the meat processing industry, where he could develop relevant practical skills and accumulate at least two years of full-time industry experience.

He followed the plan and gained the required practical experience in China.

With this experience, he was subsequently able to pursue an employer-sponsored subclass 482 pathway under the Meat Industry Labour Agreement, subject to meeting all applicable requirements.

Why This Pathway Was Significant?

One of the important features of the Meat Industry Labour Agreement is the age concession available for certain permanent residence pathways.

For eligible applicants under the applicable agreement, the maximum age for the permanent residence pathway can be up to 55 years, which is higher than the general age limit that applies to many standard employer-sponsored pathways.

For our 48-year-old client, this age concession was particularly important because it created an opportunity that may not have been available through a standard pathway.
